Shwe Eain Si's Response to the Revocation Announcement
................
1.Since 2013, Hello Madam Media Company of Building [A-3-4] Rm 604, Myanmar Gonyi Apartment, Yangon Region, being the recipient of pageant license from former Ministry of Sports, has been administering the beauty pageants for Miss Universe Myanmar competitions.
2.The aforesaid Organisation, having franchise license for Miss Grand International pageant, selected Shwe Eain Si, on 6 October 1, 2016, as Myanmar’s representative to compete in Miss Grand International pageant.
3.Without being able to issue any admissible reasons, a so-called announcement appeared on Miss Universe Myanmar’s social media Page, to the affect that the title entrusted in Shwe Eain Si of Miss Grand Myanmar had been revoked.
4.Before five groundless accusations were made, in the introductory paragraph, it is mentioned that, during the training trip to the Philippines of January 2017, Shwe Eain Si was warned by the Organisation for having exhibited conducts not suitable for a pageant contestant. This narrative is neither true nor is supported by any fact in the Announcement.
5.During that training trip, Myanmar Delegation Group was headed by Daw Soe Yu Wai, National Director of Miss Universe Myanmar Organisation and her husband Ex-Captain Tin Maung Aye, and Shwe Eain Si was assigned to act as a translator/liaison to help the group conduct its business in English in activities such as giving interviews. As the Myanmar Delegation approached the venue of Miss Universe final evening, it appeared that Ex-Captain Tin Maung Aye was trying to communicate with the driver to indicate the wrong drop off point. Realising the mistake, Shwe Eain Si immediately instructed the driver that the gate they were about to enter was the one used by the regular ticket queues and that the car should be approaching the other gate instead, where country representatives with VIP tickets were exclusively admitted. Shwe Eain Si also suggested to Daw Soe Yu Wai during the trip that, the vehicle hired by the Organisation was clearly inferior to the ones used by the other countries’ delegation and, that she, Shwe Eain Si would be happy to provide a sponsorship of a VIP limousine service for the group, without charging the Organisation for expenses. The next morning, Shwe Eain Si was warned by Daw Saw Yu Wai that, in the future such direct communication with the drivers to instruct directions should be avoided since they put her husband in some awkward and embarrassing situation. This was the one and only warning Shwe Eain Si received during the trip and it was clear that seriousness of it is far from ‘exhibiting conducts not suitable for a pageant contestant’ as mentioned in the Revocation Announcement. During the Hpa-an trip as well, the contestants were instructed by the Organisation to display a poster saying “ Welcome from Home” and Shwe Eain Si had to point it out to Daw Saw Yu Wai of the grammar mistake and that it should be just “Welcome Home.”
6.It was mentioned as the first accusation in the announcement that Shwe Eain Si should be disqualified as a contestant for her failure to produce a proof of education. This accusation is laughably childish since, from the outset, Shwe Eain Si has alrealy informed the Organisation that her certificates were left in England, and that, if the Organisaion deems they are neccessary, she would be ready to have them mailed to Yangon.
7.Shwe Eain Si found herself unavoidable on the 21 September 2017 to make a call to the Organisation, as, two days prior to that, she was informed by Daw Soe Yu Wai, during their meeting in rehearsal afternoon for the Miss Universe Myanmar crowning ceremony at Gandamar Wholsale garage, of an offer to participate in a making of a motion picture. She had already given a reply to Daw Soe Yu Wai that, the movie that was to be made from 29 September to 3 October, would be unsuitable for Shwe Eain Si, since she was to leave for Vietnam on 5 October for Miss Grand International event. She also mentioned to Daw Soe Yu Wai that her passport expiry date needs to be extended during that time. Daw Soe Yu Wai made a call after their meeting to insist Shwe Eain Si to do the film, explaining that an advanced payment had been already received by the Organisation, and Shwe Eain Si, yet again, decline the offer as it was practically impossible. She also informed Daw Soe Yu Wai that the public would not be happy if she spent her last training days making profitable movies. Daw Soe Yu Wai, kept on insisting, by saying that Shwe Eain Si should refrain from posting anything about the video making so that the public would be none the wiser.
8.On 21 September, Daw Soe Yu Wai displayed a conduct flagrantly unbecoming of a National Director, by posting a status on her social media wall that there is an irresponsible contestant who even has not extended her passport expiry date. The series of such events made Shwe Eain Si to make a call to the Organisation. Shwe Eain Si said, “ Why can’t you people show some professional behaviors? I have already extended my passport through my own connection within hours. Just because I refused to do the video, you have no right to make an issue out of my passport status. And on Facebook! Come on. I am used to far worse bloody accusations on Facebook and I never bloody well care the rubbish they wrote, so next time, if you want my serious attention, you should either ring me or ask me to come by your office.” In the Announcement, it was mentioned that Shwe Eain Si attacked the Organisation with some vulgar language, but in reality, she was just stating a general situation that she never ‘bloody’ well cares about ‘bloody’ accusations made of her in Facebook. She never mentioned bloody Organisation, bloody Soe You Wai nor, bloody Tin Maung Aye, so it was clear that she used no vulgar language against the Organisation.
9.Accusation (3) states that Shwe Eain Si failed to make herself prepared fully for her Vietman Miss Grand trip but it left one puzzled because it failed to mention specifically on which regard, has she been unprepared. She has undoubtedly extended her passport and mentioned to the Organisation that she is willing to pay for the air tickets and the Organisation replied that they would take care of her travel arrangements. The failure is clearly theirs if the Organisation has not obtained an air ticket.
10. As accusation (4) Shwe Eain Si is being alleged of breaking the Clause (6) of the Contract signed between her and the Organisation. The subsequent Clause stipulates that a beauty queen should uphold certain moral standards and the accusation in connection with this Clause principally affects the reputation and image of Shwe Eain Si. Such accusation is not only incorrect but also defamatory in nature so it is hereby categorically and vehemently denied. The very essence of the accusation warranted a legal response from Shwe Eain Si’s side and it is to be known that solicitors are being consulted to find the best avenue to proceed.
11.In accusation (5) it is alleged that Shwe Eain Si failed to project a decent image of a pageant contestant, thereby in infringement of Clause 9, but here again, lack of evidence from the Organisation’s side suggests that it was nothing more than a pathetic attempt to defame her. Yes, Shwe Eain Si made a video about the reign of terror brought about by the ARSA militants in Rakhine State, but that was hardly qualified as a failure to project a decent image of a pageant contestant. Shwe Eain Si may not be obliged, by the contract signed with the Organisation to make that video, but she is obliged as a citizen of this country to use her fame to speak out the truth for her nation. She has all along been well aware of the consequences before she made the video decided to make it all the same.
12.There is a series of accusations made in the announcement of the Organisation against Shwe Eain Si but none of them are true and certainly none are serious enough to dethrone her. If the Organisation had not been actually happy with any of the issues, they had plenty of opportunities to inform her. In fact, as recently as 20 September, Shwe Eain Si and Daw Saw Yu Wai met for the rehearsal day, but the latter acted as though it was perfectly all right and normal. They were cordially exchanging opinions about the forthcoming Miss Universe Myanmar event and the the Miss Grand International trip. Only after Shwe Eain Si refused to make the movie proposed by the organization, and the video of Rakhine State came out, the Organisation became hostile towards her. Therefore, it is hard to believe that the Organiisation conducted a behavior worthy of a National Director.
13. Accordingly, there is no way Shwe Eain Si would keep contact or association with such an Organisation with honour. She would, in due cause, return her crown, the sash, the award cash and the trophy through a respectable institution such as the Ministry of Health and Sport, from which Hello Madam received the license. In addition, a submission will be presented to the Union Minister with regards to the irregularities of Miss Universe Myanmar Organisation.
14. Expenses incurred and damages occurred due to the unilateral termination of contract by the Organisation will be demanded by civil proceedings and the amount rewarded will be donated to a charitable organization.
15.The Burmese spelling for the Announcement is wrong and it is hereby recorded.
