Decriminalized Homosexual acts in India.
The only female judge on the bench, Justice Indu Malhotra in her judgement went on to say that-
"History owes an apology to the members of the LGBT community and their families for the delay in providing redressal for the "ignominy" and "ostracism" they have faced through the centuries. The members of this community were compelled to live a life full of fear of reprisal and persecution."
Chief Justice of India justice Dipak Misra quoted Goethe by saying that-
"I am what I am, So take me as I am"
Another judge on the bench Justice J Chandrachud wanted to address the issue of Marriage Equality as well, who in his judgement said that "LGBTQ have the right to constitutional equality in all it's manifestations", but on the objection of State Lawyer they decided to address the nondiscrimination of homosexual acts only, for now. But, nonetheless the strong judgement paves the way for other rights like Marriage Equality, adoption, etc., as Supreme Court in the judgement said that,"Popular morality cannot prevail over constitutional morality because this section may be a minority."
This is a huge win, especially after the 2013 setback when this law was brought back after being taken down in 2009 and Supreme Court has addressed that decision as a big mistake and gave Indian LGBTQ community the rights they deserve. This back and forth did bring a large section of Indian society to band together and fight for Queer rights and as a result Supreme Court received a record number of petitions against the archaic law, from NGOs to IITians all came out to demand LGBTQ rights.
There is a long road ahead to Equality, but this decision and it's contents are a giant source of hope for persecuted LGBTQ communities around the world.
